The following is my answer to a Quora question: “What resolution do you see for returning ISIS fighters and fighters’ wives, that satisfies our moral needs both to forgive our neighbour and to protect our children?”
There are only a few legal resolutions. If they are dual citizens, the state has the
option of stripping them of their citizenship. International law does not allow a state to
make people stateless. If they were not
fighters, they still have to undergo a deradicalisation programme. Even then, their active support of ISIS means
that they are liable to prosecution under sedition laws. If they were combatants, they are guilty of
sedition, and the severest penalties allowed by law should be applied to them. Preferably, it is the death penalty. We can talk of forgiveness after the legal
process.
